1. Acceptance of these terms
By creating an account, browsing, or transacting on the Gydrus Marketplace ("the Platform") you agree to these Terms. If you do not agree, do not use the Platform.
2. Eligibility
- You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher.
- You must not be a resident of a country subject to a comprehensive sanctions regime.
- One account per person.
You also confirm that you are not on, and do not act on behalf of anyone on, any sanctions list (including OFAC, EU, UN or UK lists), and that you will not use the Platform for any transaction involving a sanctioned country, entity or person. We may block, freeze or reverse any activity we reasonably believe breaches applicable sanctions or export-control law.
3. The Platform's role
Gydrus operates a peer-to-peer marketplace. We are not a party to any transaction between buyers and sellers. We hold buyer funds in escrow during the dispute window (default 14 days) and release them to the seller when that window closes without an open dispute. Our role is custodial and dispute-resolution only.
4. Account registration and security
- You are responsible for all activity under your account.
- Two-factor authentication is strongly recommended.
- You must keep your contact details current.
5. Listings, prohibited content
Listings must comply with applicable law and with the publishers' terms for any game involved. The trading of game accounts is prohibited under the EULAs of most publishers. You acknowledge that you assume the risk of account recovery, bans, or other consequences arising from publisher action.
Prohibited listings include but are not limited to:
- Items whose sale is restricted by law (firearms, controlled substances, etc.).
- Stolen accounts or credentials.
- Hacked, cheated or banned accounts.
- Anything that infringes a third party's intellectual property.
6. Fees and escrow
- Buyers may pay a small surcharge on certain payment methods (disclosed at checkout).
- Sellers pay a commission per sale (set per game; see the Seller Agreement for current rates).
- Funds are held in escrow for the configured hold period (default 14 days). The seller's earnings, the buyer's loyalty coins and the sale counters all settle together when the timer expires without an open dispute.
7. Disputes
See the Refund & Dispute Policy. The Platform's dispute decisions (including admin escalations) are final for the purposes of escrow release.
8. Intellectual property
The Platform's branding, code and design are owned by Gydrus SAS. Game names, logos and trademarks remain the property of their respective owners; their appearance on the Platform does not imply endorsement.
9. Limitation of liability
To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied or statutory. Gydrus SAS is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of the Platform.
Our aggregate liability to you for any claim arising out of or in connection with these Terms is limited to the greater of (i) the fees we earned from you in the twelve months preceding the event giving rise to the claim, or (ii) USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Uruguayan consumer-protection law or any other applicable mandatory law.
10. Termination
We may suspend or terminate an account for breach of these Terms, fraud, abuse, or as required by law. You may close your account at any time once any open orders and disputes have settled.
We may also treat an account as inactive after a prolonged period with no sign-in (at least 12 months). We may contact you before taking any action, and you can reactivate simply by logging in. Any wallet balance remains yours and is returned through the normal withdrawal flow on request.
11. Governing law and venue
These Terms are governed by the laws of the República Oriental del Uruguay. Any dispute arising out of or in connection with these Terms shall be submitted to the courts of Montevideo, Uruguay, to the exclusion of any other jurisdiction.
12. Changes to these Terms
We may revise these Terms from time to time. When a revision is material we will require you to re-accept before continuing to use the Platform. The current version and last-updated date are shown at the top of this page.
